On 10 July, the EU Commission adopted a new adequacy decision recognizing that data privacy standards in the US are as adequate as in the EU. This allows free flow of personal data between the EU and the US while ensuring data protection is in line with the EU standards.
The decision is based on US commitments and assurances, mainly, the US Executive Order on Enhancing Safeguards for United States Signals Intelligence Activities, which address the concerns raised by the CJEU in Schrems II decision in 2020.
The decision is subject to periodical reviews to make sure if the US legal framework functions effectively in practice.
