On December 14th, the European Commission has published its draft adequacy decision for the U.S. following the Executive Order signed on October 7th by Joe Biden for implementation of the agreed Trans-Atlantic Data Privacy Framework into U.S. law.

In its draft decision, the EU Commission evaluated the US legal framework and determined that the US legal framework provides adequate level of protection for the European’s data as in the EU. Once the draft decision is final, data can freely flow between EU and U.S. companies that joined the framework.

What is next?

After receiving an opinion of the European Data Protection Board, the Commission will ask for approval from the EU Member States. Once the draft decision is greenlighted, the EU Commission will adopt the final adequacy decision.

The final decision will be subject to periodic reviews to ensure the effective functioning of the U.S. legal framework in practice.
